1. Acceptance of Terms
By accessing and using Provncloud ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use the Service.
2. Service Description
Provncloud provides blockchain anchoring and timestamping services. You acknowledge that:
• We are an infrastructure provider, not a data storage provider.
• Anchoring proofs to a supported settlement network (including Solana) is an irreversible action.
• We cannot retrieve your original data if you lose it.
3. User Obligations
You agree not to use the Service to anchor illegal content. While we cannot see your data (due to hash-only architecture), we reserve the right to terminate accounts that are verified to be using the service for malicious purposes via metadata analysis.
4. Payment & Refunds
Services are billed on a subscription or per-call basis. Due to the immutable nature of blockchain transaction fees, all payments for executed anchors are non-refundable. If an error in the system causes a failed anchor, account credit may be issued at our discretion.
5. Disclaimer of Warranties
The Service is provided "as is". We facilitate the cryptographic anchoring of data fingerprints through our high-availability infrastructure, while consensus finality is subject to the decentralized settlement network protocols in use.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Provncloud and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the total amounts paid by you to Provncloud in the twelve (12) months preceding the claim, or (b) €100.
7. Indemnification
You agree to indemnify, defend, and hold harmless Provncloud and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.
8. Governing Law
These Terms of Service and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles. As a consumer, you may also benefit from mandatory provisions of the law of the country in which you reside.
9. Dispute Resolution
In the event of any dispute, you agree to first contact us at provncloud@provnai.com and attempt to resolve the dispute informally for at least 30 days before initiating any formal proceedings. If the dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts of Belgium.
